Condemnation, though not always popular, is sometimes necessary. An understanding of Missouri’s post-Kelo condemnation process (both from a timing and substantive perspective) is vital to a successful public project. 

Our firm has handled more than a dozen condemnation actions. We have experience with a variety of complexities that can arise, from establishing public necessity and public purpose criteria for “traditional” exercises of eminent domain (e.g., streets, sidewalks, water and sewer facilities), and “non-traditional” exercises of eminent domain (e.g., subdivision restrictive covenant, leases), to handling appraiser expert witnesses and litigating the appropriate measure of damages.
